We have an insured with an HO-3 policy. He is planning to have a “carnival” for kids in his large side yard. He plans to invite selected friends and expects an attendance of 50 to 100 people. The purpose is to raise money for Cystic Fibrosis. He plans to ask for a $5 per person donation, with all proceeds going to the charity. However, the Cystic Fibrosis Foundation is not a party to this event.

The insured is renting a “Moonbounce” and will have other carnival games such as a ring toss, etc. The Moonbounce firm is not asking to be an additional insured, so that is not an issue.

My question is whether the “donation” angle could trigger the exclusionary definition of a “business.” The underwriter at the carrier is said to be “unhappy” about this exposure, but my concern is whether the event would be covered for liability or medical payments, not the underwriter’s state of mind.

Our client was trying to pull his boat out of the water (his property is directly on the water). First, he borrowed a neighbor’s truck, but the truck couldn’t do the job. I’m concerned about the mortgagee notice provisions in the Insurance Services Office Inc. homeowners contracts. The policy language states, “If we decide to cancel or not to renew this policy, the mortgagee will be notified at least 10 days before the date cancellation or nonrenewal takes effect.”

What if the named insured requests cancellation? Will the mortgage holder be notified? We are concerned about there being a loss, and the bank possibly suing this agency for not letting them know the coverage was canceled?

We have a client who is building a new homeon a vacant lot he owns. He currently is renting and has an HO-4 policy. We asked the carrier if this HO-4 extends liability to this currently vacant piece of property and will this liability coverage stay in place during construction. The carrier uses the ISO HO 00 04. This is their response: liability is extended at no extra charge to vacant land as long as the vacant land is included in the declarations listed and listed as an additional premises. Once the land is no longer vacant, i.e., construction begins, liability will no longer be extended. It sounds like the insured should consider a builders’ risk for the new home. Is this accurate?

Swimming pool—water delivery

An insured suffered a covered swimming pool loss where the liner had to be replaced. Of course, to get to the liner, the water had to be drained. There is an agreed price between the carrier and the pool contractor for the replacement liner. Our insured is out the cost of the water that was drained and the insurance carrier says water is “excluded.” While we can agree that water is not covered, we are taking the position the carrier must cover the cost of labor to replace the water similar to a wall that a contractor needs to tear down to get to a leaky pipe.

Roof’s undamaged portion

I have a homeowners insured with a roof claim who has a detached garage and there is considerable shingle damage to one slope of the roof. The other slope has suffered no shingle damage but the shingles are old and dried out and there is some moss on the shingles of the other slope. The carrier says it is not responsible to replace the shingles on the other (undamaged) slope of the roof. They will pay to replace all of the shingles on the damaged slope. Power Failure

I just had a claim denial for a power surge to a central air-conditioning unit. The insurer is claiming the air-conditioning unit is excluded under Coverage C—Personal Property.
