Yes. The vehicle owner and registrant must be the applicant, according to N.J.A.C. 11:3-6.3-(e)3: "The surname of the insured must agree with the surname shown on the insured motor vehicle’s current motor vehicle registration as issued by the New Jersey Motor Vehicle Commission."

My insured suffered a fatality. Now the company wants to deny the death benefit and funeral expense provisions of the personal injury protection coverage. They say the benefits do not apply because the insured did not die within 48 hours after the accident. I’ve never heard of this rule.
The company is wrong. The only requirement found in the statute (Section 39:6A-4) and in the coverage form (PP 05 77) is that the claimant’s death must result from the covered injury. There is no reference to a time period.
